זה אחי אינו נאמן: ואידך מאי קאמרי אי קאמרי אחונא הוא אמאי יטול עמו בחלקו ותו לא אלא דקא אמרי לאו אחינו הוא

and at the time of his death he declared that he had no brothers, [in considering the case.] R.
